Welcome to Estefi Creates. These Terms of Service (“Terms”) govern your access to and use of esteficreates.com and esteficreates.myshopify.com (collectively, the “Services”), operated by Estefania Hernandez (“Estefi Creates”, “we”, “us”, or “our”).
By accessing or purchasing from our Services, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services.
Our Services are powered by Shopify. Any purchases you make are made directly with Estefi Creates; Shopify is not a party to any sales transaction.
Section 1 – Access and Account
By agreeing to these Terms, you confirm that you are at least the age of majority in your jurisdiction, or that you have the consent of a parent or guardian.
You may be asked to provide your name, email address, and payment or shipping information when placing an order. You represent that all information you provide is accurate, current, and complete. You are solely responsible for maintaining the security of your account credentials.
Section 2 – Products
All original artworks listed on our Services are one-of-a-kind pieces created by Estefania Hernandez. We make every effort to represent our products accurately, including providing dimensions and descriptions on each product page.
Please note that colours and appearance may vary slightly depending on your device’s screen settings and calibration. We do not warrant that the visual representation of any product will exactly match the physical item. We reserve the right to modify or discontinue any product at any time without notice.
Section 3 – Orders
When you place an order, you are making an offer to purchase. Estefi Creates reserves the right to accept or decline any order at its sole discretion. Your order is not confirmed until you receive an order confirmation by email. Payment must be received and processed before an order is accepted.
Please review your order carefully before submitting. Once accepted, Estefi Creates may be unable to accommodate cancellation requests. If we decline, modify, or cancel an order, we will notify you using the contact details you provided.
All purchases are subject to our Refund Policy.
Section 4 – Prices and Billing
All prices are listed in euros (€). Applicable taxes will be displayed at checkout. Prices are subject to change without notice; the price charged will be the price in effect at the time your order is placed, as confirmed in your order confirmation email.
Unless expressly stated, posted prices do not include shipping, customs, or import charges. You agree to provide accurate and complete payment information and to pay all charges incurred, including applicable taxes and shipping fees.
Section 5 – Intellectual Property
All content on our Services — including artworks, images, text, graphics, logos, and design — is the property of Estefania Hernandez (Estefi Creates) and is protected by Spanish, EU, and international intellectual property law.
Purchasing an artwork does not transfer copyright or any reproduction rights. Estefi Creates retains all rights to reproduce, distribute, and publicly display its works. Purchased artworks are for personal or decorative use only and may not be reproduced or used for commercial, editorial, or advertising purposes without prior written consent.
Shopify’s name, logo, and trademarks are the property of Shopify Inc. All other third-party trademarks referenced on the Services belong to their respective owners.
Unauthorised use or reproduction of any content may result in legal action, including DMCA takedown notices, cease-and-desist letters, and civil claims for damages under Spanish and international intellectual property law.
Section 6 – Shipping and Delivery
All original artworks are shipped from Valencia, Spain. Delivery times are estimates only and are not guaranteed. We are not liable for delays caused by shipping carriers, customs processing, or events outside our control. Once an order is transferred to the carrier, risk of loss passes to the buyer.

Section 7 – Third-Party Fulfilment
For certain products, orders may be fulfilled and shipped by trusted third-party production and fulfilment partners. Shipping times, methods, and tracking availability may vary depending on the product and your location.
Returns and exchanges for third-party fulfilled products are subject to those partners’ policies. If you experience any issue with your order, please contact us at [email protected] and we will do our best to resolve it promptly.
Section 8 – Third-Party Links and Tools
Our Services may contain links to third-party websites (such as YouTube or affiliate partners) and may provide access to optional third-party tools. We do not control, monitor, or endorse these sites or tools, and we are not responsible for their content, accuracy, or privacy practices.
Your use of third-party links or tools is at your own risk. We encourage you to review the terms and privacy policies of any third-party site before engaging with it.
Section 9 – Relationship with Shopify
Our store is powered by Shopify. All sales and purchases are made directly with Estefi Creates. Shopify is not responsible for any aspect of any transaction between you and Estefi Creates, including any injury, damage, or loss resulting from purchased products. By using the Services, you expressly release Shopify and its affiliates from all such claims.
Section 10 – Privacy Policy
All personal information we collect is subject to our Privacy Policy, available at esteficreates.com/privacy-policy. Shopify also processes certain personal information as part of providing the platform; their privacy policy is available at shopify.com/legal/privacy. By using the Services, you acknowledge that you have read these policies.
Section 11 – Feedback and Reviews
If you submit feedback, reviews, suggestions, or other content (“Feedback”) to us, you grant Estefi Creates a perpetual, worldwide, royalty-free licence to use, reproduce, modify, publish, and distribute such Feedback for any purpose, including improving and promoting the Services.
You represent that you own or have all rights to your Feedback and that it does not infringe the rights of any third party. We reserve the right to remove Feedback that we determine to be unlawful, offensive, or otherwise in violation of these Terms.
Section 12 – Prohibited Uses
You may use our Services only for lawful purposes. You may not:
- Use the Services for any unlawful, harmful, or fraudulent purpose
- Infringe upon our intellectual property rights or those of any third party
- Transmit false, misleading, or unsolicited communications (spam)
- Upload or transmit viruses or malicious code
- Collect or harvest personal information of other users
- Attempt to interfere with or circumvent the security of the Services
- Reproduce, resell, or exploit any portion of the Services without our written consent
Section 13 – Errors, Inaccuracies, and Omissions
We reserve the right to correct any errors, inaccuracies, or omissions in product descriptions, pricing, availability, or other information at any time without prior notice, including after an order has been submitted.
Section 14 – Disclaimer of Warranties
The Services and all products are provided “as is” and “as available” without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Services will be uninterrupted, secure, or error-free. Some jurisdictions do not allow the exclusion of implied warranties, so the above may not apply to you in full.
Section 15 – Limitation of Liability
To the fullest extent permitted by law, Estefi Creates, its affiliates, directors, employees, and service providers shall not be liable for any indirect, incidental, punitive, special, or consequential damages — including lost profits, lost data, or replacement costs — arising from your use of the Services or any products purchased through them, even if advised of the possibility of such damages.
Section 16 – Indemnification
You agree to indemnify, defend, and hold harmless Estefi Creates, Shopify, and their respective affiliates, officers, directors, employees, and agents from any losses, damages, liabilities, and costs (including reasonable legal fees) arising out of (1) your breach of these Terms, (2) your violation of any law or third-party rights, or (3) your use of the Services.
Section 17 – Termination
We may suspend or terminate your access to the Services at any time, without notice, if you violate these Terms. Sections relating to Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law will survive any termination.
Section 18 – Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Spain and the European Union. Any disputes arising from or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Valencia, Spain.
EU consumers also have the right to use the European Commission’s Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr
Section 19 – Severability, Waiver, and Entire Agreement
If any provision of these Terms is found to be unlawful or unenforceable, that provision will be severed and the remaining Terms will remain in full force. Our failure to enforce any right or provision does not constitute a waiver of that right.
These Terms, together with our Privacy Policy, Refund Policy, and Shipping Policy, constitute the entire agreement between you and Estefi Creates regarding the Services.
Section 20 – Changes to These Terms
We reserve the right to update these Terms at any time. When we do, we will revise the date at the top of this document. For material changes that affect your rights or obligations, we will provide advance notice via email or a prominent notice on the website. Your continued use of the Services after any changes constitutes acceptance of the revised Terms.
